High Court directed Police to Lodge FIR against accused in Incest case


Islamabad : The Islamabad High Court has directed police officials of Golra to register an FIR against a father accused of molesting with his daughter.

The Single member bench comprising Chief Justice Iqbal Hameed-ur-Rehman resumed hearing of the petition seeking registration of criminal case against accused and protection order for the teenaged girl.

Accepting the plea for registration of an FIR, the Chief Justice cited a judgement of the Supreme Court (PLD, 2007), and said that no inquiry could be held before the registration of FIR.

Arif Khan, counsel for accused, contended that the charges leveled against his client were baseless entailing a family dispute.

He prayed to the Court not to pass any order before the completion of DNA report.

In earlier hearing, the girl (NS) through her counsel Saeed Khursheed Ahmed Panuhan, apprised that her father Liaqat Ali had defiled her modesity after forcibly ousting her mother and brother from the house with pre-determined plan and later survived a murder attempt when she disclosed the inhuman act to her sister and other family members.

Panuhan said after the incident, she was examined in the Islamabad Hospital Complex and a DNA report was still awaited, but he alleged that the PIMS hospital issued a medico-legal report in favour of the accused.

According to him, the petitioner was under the constant threat to her life because the accused and his brother Shaukat Ali were looking her and she was living in a crisis center of Islamabad by the orders of Magistrate.
